Oregon Law Alert: Age Inquiries Prohibited Until After Initial Interview

Beginning September 26, 2025, Oregon employers of all sizes won’t be able to ask or require applicants to provide their age, date of birth, or school attendance or graduation dates prior to completing an initial job interview. If there’s no interview, the employer can’t ask prior to a conditional offer of employment.

However, employers can request this information to verify that the applicant meets a genuine bona fide occupational qualification or to comply with an applicable law. For example, an employer can ask for a birth date to verify that the applicant is old enough to sell or serve alcohol if that’s part of the job.

Action Items

Ensure your job applications (including software systems you may use) don’t ask for or require birth, school attendance, or graduation dates. If age needs to be verified, make sure you’re only asking on the application for that particular job type.
Make anyone involved in the hiring process aware of these restrictions.
